if someone crashes on government property while on cellphone, whats their liability?

So we have to do this for my legal and ethics class and I can not find the information. Basically the defendant was trying to make an emergency cellphone call while driving and crashed into a tree… what is his liability for the tree?? Also this is in CA and he has 3 prior cellphone violations, is his penatly just $50?
