We rent our home through a property management company and we have been informed that the property is for sale. The property manager, who is also the listing agent, would like to property to be vacant for showings and has given us a thirty day notice to terminate the lease 1 month early, if we agree. We really want to move and have found a better place to live, however, he now stipulates that we would have to agree to have his property management fee for one month taken out of our security deposit. We are not terminating the lease and shouldn’t the owner be responsible for this amount?

I own a duplex in Upstate NY. I live in one side and rent the other. I put the property up for sale last month. My problem is, the agent can never get in to see the rental side because the tenant is never there when she shows up. The agent calls her with 24 hrs in advance, but she never picks up the phone and claims she never got the message on her machine. When she is there she claims she is too busy to show. What are my rights as a seller? If I give the tenant 24 hrs notice can I just go in and show the property? The tenant told me she will call the police if I go in and it is not an emergency. Do I have any legal recourse because she is hindering the sale of my property. If anyone can give me advice, please let me know. Thanks

my husband signed a contract april 17th. for sale of property.The agent changed the earnest money from 500. to a 1000. due after A/I, what does that mean? He didn’t Initial one part in the contract so she sent it back for him to do so. I asked her what was the buyer planning on doing with the property she said she didn’t no she would find out. She calls three days later and said she just saw it in the contract and he wants the building vacant. I told her and the attorney that I wanted the contract canceled until june 1st. unless they would agree on her staying until aleast the middle of june. The closing is suppose to be may 20th. At that timewhich i believe was the 21st or 22 of april. the lawyer said she would talk to the sellers attorney and get back with me. she finally called and said they would let her stay and charge her day by day for the cost of te building taxes and Ins. Is this right ? What about the earnest money. I think my agent is working for the buyer too.

We are trying to short sale our house and were approached by some people from up north that wanted to buy some property here in Florida and rent it out or a copule of years. They offered to buy our short sale house if we would sign a 2 year lease and rent from them. At the end of the 2 years they would like to either move into the house, or sell it, possibly back to us at the appraised amount. Can this be done? I have only heard of this as an issue of having family buying a short sale so their family members can stay in their own house by renting it and then maybe buy it back when it could be afforded.

We rent out lot for someone to put a trailer on. We have been trying to sell our home and lot with a for sale sign in the yard. We have asked them not to advertise their trailer with a sign in the yard but they could on the trailer they are being very difficult and threatening and doing so anyways. Is this legal for us not to let them?
