Can I legally sale Property that I have rented and lease is not up.In the state of Missouri?

The renter has been a problem from the start.I had to work with her on deposits,Security deposit,water electric.She is now stating someone is breaking into the house and has got a dog.I have a extra deposit for a dog and the rent is an additional $100 which she refuses to pay.The other thing is she is pregnant and due in a few months.Im tired of the headache and would like to sale the house,but can I with a lease that is still good till November of 2010.

Yes, but the buyer would be required to honor the current lease. With the current housing market, it would probably cost you quite a bit.
You can sell anything that is not something prohibited by law. You might have to come to an arrangement with the new owner about allowing the tenant to fulfill the lease but that is all. Many people buy and sell tenanted houses. Some buyers who are looking for an investment property will prefer one that has a tenant.
With regard to the extra rent for possessing the dog, unless that was clearly stipulated in the original lease then you might have difficulty enforcing that condition. If it was then it shouldn’t be too difficult.
As said in the last answers, you could sell the house with the tenant in it. And the only way you can inforce the extra money for the dog is if it was spelled out in the lease agreement. Also, if she is pregnant and due in a few months, what kind of person would that make you if you were to kick her out? No offense, but that’s pretty harsh.
Renting is a headache and probably always will be. I’d wait until the lease was up and sell it.
