**Revised** Do I still have to pay my rent even though the property is listed for sale on 7/29/09?

Thank you to everyone who answered my question. But maybe I should have been more specific. It’s going on a foreclosure sale in 7 days, not a listing sale. Landlord has not been paying on his mortgage since the day we moved in, on top of it, he’s threatening me that he can kick me out the next day if I do not pay him.

Morally, you should pay your rent if you’re living there. Legally, he cannot kick you out the next day. Renters have 90 days to leave once an eviction notice has been documented as received (via certified letter or someone who serves documents in person). To physically move you out himself would land him in jail.
I suggest you pay weekly for the time you are staying there, and hurry up and get out of there, as you’ll need to eventually anyway.
Put it into an escrow account, banks are presently letting you rent from them for 90 days so you have time to move.
You owe the landlord rent for July.
