Signed a 12 month contract to rent a property but now want to move out and buy a property HELP?

Hi,
Me & my partner are currently renting a property, we had 6 months on it, after this time was up we then went in and signed for another 12 months…we did this due to the fact we have a 7 month old daughter and wanted some stability.
Anyway…now a property has come up for sale down the street us and the seller know each other very well so they are eager to sell to us and we are eager to buy as it is what we want.
thing is because we signed a 12 months tenancy agreement would it be possible for us to move out before it ends? We are 4 months in to the 12 months.
We just want to know what our options are, worst case and best case.

At worse, maybe you could sub let it?
You can pay 8 months rent and move out or more from court costs if you try to break the contract.
I dont know exactly but I think you can move out but you will have to pay the remaining rent for the rest of the contract.

Hi, talk to the landlord or agents and tell them the situation. Usually a way can be found. They may suggest you find some one to take over the remaining time subject to getting references, or they may say, when you are ready to leave, you have to pay until a new tenant can be found, they can be looking if you can give a date, but it may take you some time to get the mortgage up and running and the paperwork sorted before you can move. If yours is a popular area and people are looking for rented places, then there may only be a few days cross over when you move out and new people move in. Make sure you leave the place spotless, so the landlord does not have to get the cleaners in therefore taking more time.
Best case scenario that you speak to your landlord or agent explain what has happened and ask if they are willing to let you break your contract early.
Worse case they tell you no and you have to either pay the last 8 months rent in full or stay where you are and see if another house becomes available.
legally you cannot walk out of a lease if it states you will stay the full 12 months.
With a bit of luck the tenancy agreement should have a break clause which should allow you to serve notice to cease the tenancy before the 12 month term.
With a 12 month tenancy it would be normal that the break clause would be active after 6 months.
Therefore if this was the case given you’re 4 months into the new tenancy agreement, with the relevant notice you should be able to get out of the tenancy on the 6th month.
I’m sure your need two months to get a house purchase sorted anyway.
If the tenancy doesn’t have a break clause then your best bet is negotiation to end the lease as otherwise your going to end up being chased (as a debtor) for the remaining lease and others costs as can be considered as damages associated with you abandoning the lease.

What does the contract say?
You cant sub let as one person states – your tenancy will not allow you to do so. Discuss the sitation with your landlord and explain your circumstances and see what arrangement you can come to. Perhaps you could offer to pay advertising costs or agency fees the landlord would incur to find another tenant? If your landlord is approachable then you have nothing to lose – perhaps fees and lose your deposit – but without asking you will never know.
